Preferential Tax for Special Groups

Senior citizens and persons with disabilities (PWDs) enjoy significant tax benefits. Their compensation as minimum wage earners is exempt from income tax, and they receive a 20% discount on various goods and services.

For establishments, these discounts are deductible from gross income/sales/receipts at a rate not less than the statutory rate. Only one discount applies if a person qualifies as both a senior citizen and PWD—they get the higher discount between promotional and SC/PWD discounts.

Establishments also receive tax incentives for hiring senior citizens and PWDs:

  • 15% deduction for employing senior citizens (whose income doesn't exceed poverty level)
  • 25% deduction for hiring PWDs (with DOLE certification)
  • 50% deduction for facility modifications to accommodate PWDs

Pro Tip: Senior citizens also receive a 5% discount on monthly water and electricity bills (maximum of 100kWh for electricity and 30 cubic meters for water per household), which can significantly reduce monthly expenses.

CREATE Law Benefits

The Corporate Recovery and Tax Incentives for Enterprises (CREATE) Act offers substantial incentives for registered businesses:

Export Enterprises (those with 70% of sales exported) and qualifying domestic enterprises enjoy:

  • Income Tax Holiday (ITH) of 4-7 years
  • Special Corporate Income Tax (SCIT) of 5% on gross income for exports
  • Enhanced deductions for domestic enterprises

Additional enhanced deductions include:

  • 50% additional deduction on labor expenses
  • 100% deduction for R&D directly related to business
  • 100% training deduction for Filipino employees

The Strategic Investment Priority Plan (SIPP) classifies investments into three tiers with corresponding benefits, encouraging investments that create jobs, support critical industries, and drive innovation.

Taxpayer Remedies

When dealing with tax assessments, you have specific rights and remedies. The process typically begins with a Letter of Authority (eLOA) from a Revenue Officer, which must be served within 30 days.

If discrepancies are found, you'll receive:

  1. Notice of Discrepancy (30 days to provide documents)
  2. Preliminary Assessment Notice (PAN) (15 days to reply)
  3. Final Assessment Notice (FAN) (30 days to protest)

When you disagree with an assessment, you can file either:

  • Request for Reconsideration (based on newly discovered evidence)
  • Request for Reinvestigation (requiring additional documents)

If your protest is denied, you can appeal to the Court of Tax Appeals (CTA) within 30 days.

Important: Failure to file a protest on time makes the assessment final, executory, and demandable! Always respond within deadlines.

Government Remedies

The government can assess taxes within 3 years from the filing date (10 years in cases of fraud). For collection, they have 3 years after the assessment becomes final 5yearsforfraud/omission5 years for fraud/omission.

Collection methods include:

  • Distraint (seizure of personal property)
  • Levy (seizure of real property)
  • Court action (civil or criminal)

Civil Penalties

Taxpayers face different penalties based on violation type:

  • 25% surcharge: Failure to pay on time or in correct venue
  • 50% surcharge: Willful neglect, false returns, or filing after written notice
  • 12% interest: On deficiency and delinquent taxes
  • Administrative penalties: Range from P1,000 per failure (max P25,000 per year)

Both taxpayers and the government can enter into compromise settlements as a last resort, with minimum amounts of 10% (financial incapacity) or 40% (doubtful validity) of the basic tax.

Excise Tax System

Excise taxes are imposed on specific goods based on either their value (ad valorem) or volume (specific). The computation follows this sequence: remove VAT, add excise, then add VAT again.

Key products subject to excise tax include:

  • Automobiles (with exemptions for buses, trucks, special purpose vehicles, jeepneys, and purely electric vehicles)
  • Mineral products (4% on actual or customs value)
  • Cosmetic surgery (5% on gross receipts for invasive procedures)
  • Non-essential goods (jewelry, perfumes, tobacco products, alcoholic beverages)
  • Sweetened beverages (except 100% natural fruit juice, milk products, and coffee)

Did you know? Hybrid vehicles receive a 50% excise tax exemption, while fully electric vehicles are completely exempt.

Documentary Stamp Tax (DST)

DST applies to documents, instruments, and transactions. If unpaid, documents remain valid but cannot be recorded in official registries or admitted in court.

Common DST rates:

  • Original issuance of shares: P2 per P200 of par value
  • Sale of previously issued shares: P1.5 per P200 of par value
  • Debt instruments: P1.5 per P200 of issue price
  • Life insurance policies: Ranging from P20 to P200+ depending on amount
  • Property insurance: P0.5 per P4 of premiums
  • Leases: P6 for first P2,000 plus P2 for every additional P1,000
  • Sale/donation of real property: P15 per P1,000 of consideration or fair value

Certain transactions are exempt, including government grants, tax-free exchanges, and instruments required in legal proceedings.

DST must be paid by the 5th day of the following month after the taxable document is made, signed, issued, accepted, or transferred.

Value-Added Tax (VAT)

VAT is a consumption tax that may be shifted to consumers. The standard rate is 12% on most goods and services.

Taxpayers are required to register for VAT when:

  • Their gross sales/receipts exceed P3,000,000 in the previous 12 months
  • They reasonably expect their gross sales/receipts to exceed P3,000,000 in the next 12 months

Those with gross sales/receipts not exceeding P3,000,000 may opt for:

  • 8% income tax on gross sales/receipts (in lieu of percentage tax and income tax)
  • 3% percentage tax fornonVATregisteredfor non-VAT registered

VAT applies to:

  • Sale of goods or properties
  • Sale of services
  • Lease of properties
  • Importation of goods

Remember: For mixed income sources, compensation income is always subject to graduated tax rates, while business/professional income may qualify for the 8% flat rate option.

  • Medical services (except those rendered by professionals)
  • Educational services from private institutions accredited by DepEd, CHED, or TESDA

Transportation VAT Rules

  • Land passenger transport: 3% percentage tax
  • Domestic air/water passenger transport: 12% VAT
  • International transport PHAbroadPH-Abroad: Exempt for passengers, 3% for goods

  4. The expense is directly attributable to the business
  5. Proper documentation exists (invoices, receipts)

Special provisions include:

Estate Tax Essentials

Estate tax is imposed on the transfer of properties upon death at a flat rate of 6% on the net taxable estate. The tax applies to:

  • All properties of residents/citizens wherever located
  • Philippine properties of non-resident aliens

The estate tax computation begins with the gross estate (fair value at time of death), followed by deductions:

Ordinary Deductions:

  • Claims against the estate
  • Unpaid mortgages
  • Losses within one year of death
  • Unpaid taxes (except income, real property, and estate taxes)
  • Transfers for public use

Special Deductions:

  • Family home (up to P10,000,000)
  • Standard deduction P5,000,000forresidents/citizens;P500,000fornonresidentaliensP5,000,000 for residents/citizens; P500,000 for non-resident aliens
  • Retirement benefits (RA 4917)

Planning tip: The family home deduction can significantly reduce estate tax liability, but remember it only applies to properties in the Philippines.

Estate Tax Filing Requirements

  • Who files: Administrator or executor
  • When: Within 1 year from decedent's death
  • Extensions: Up to 30 days for filing; up to 5 years for payment (judicial settlement) or 2 years extrajudicialsettlementextra-judicial settlement

Bank withdrawals made within 1 year of death are subject to 6% final withholding tax, unless the amounts are included in the gross estate.

Community Property Rules For married individuals, property classification depends on when and how assets were acquired:

  • Properties owned before marriage remain exclusive
  • Properties acquired during marriage through gratuitous title (gifts, inheritance) remain exclusive
  • Properties acquired through labor or industry during marriage are generally considered community or conjugal property

Donor's Tax Fundamentals

Donor's tax is imposed on transfers made during one's lifetime (inter vivos) at a flat rate of 6% on total gifts exceeding P250,000 within a calendar year.

A valid donation requires:

  • Donor's capacity
  • Donative intent
  • Acceptance by the donee

Taxable Donations Include:

  • Property transfers with less than full consideration
  • Renunciation of conjugal/community property share by surviving spouse
  • Forgiveness of debt without other consideration

Exemptions:

  • Gifts to government, non-profit agencies, or political subdivisions
  • Campaign contributions (if utilized and reported)
  • General renunciation of property not specifically designated

Important distinction: For real property that is a capital asset, capital gains tax applies instead of donor's tax.

Filing Requirements

  • When: Within 30 days after the gift
  • Where: Where the donor is registered

Capital Gains Tax

Capital gains tax applies to gains from selling capital assets:

  • Shares of domestic corporations:
    • Unlisted: 15% of net capital gain
    • Listed (through PSE): 0.6% stock transaction tax on selling price
  • Real property (capital asset): 6% of gross selling price or fair market value, whichever is higher

Special Rules:

  • Sale of principal residence is exempt if proceeds are fully utilized to acquire a new principal residence within 18 months
  • This exemption can be availed once every 10 years

For individuals, capital gains/losses follow the holding period rule:

  • 100% of gain/loss is recognized if asset is held for 12 months or less
  • Only 50% is recognized if held for more than 12 months

For casual sales on installment, capital gains tax is computed as: TotalCGT/ContractPriceTotal CGT/Contract Price x Installment Collection

The EOPT, effective January 22, 2024, modernizes Philippine tax administration with these key changes:

Electronic Filing and Payment:

  • Tax returns can be filed electronically or manually
  • Manual filing allowed only when systems are unavailable or for justifiable reasons

Taxpayer Classification:

  • Micro: Less than P3,000,000 gross sales
  • Small: P3,000,000 to less than P20,000,000
  • Medium: P20,000,000 to less than P1,000,000,000
  • Large: P1,000,000,000 and above

VAT Changes:

  • Tax base is now gross sales (previously gross receipts for services)
  • Method changed to accrual basis (previously cash basis for services)
  • Single invoice requirement for both goods and services
  • Output tax credit available for uncollected receivables

Important change: VAT on services now uses the accrual method, meaning you must declare and pay output VAT when the sale occurs, not when payment is received.

Tax Refund Improvements:

  • Refund applications classified as low, medium, or high-risk
  • 180-day decision period for VAT refund claims
  • Officials face administrative liability for failing to process claims on time

Reduced Penalties for Small Taxpayers:

  • 10% civil penalty rate for micro and small taxpayers (reduced from 25%)
  • 50% reduction on interest rates
  • Reduced compromise penalties of at least 50%

Simplified Registration:

  • One-time registration requirement

Taxpayer Remedies

When dealing with tax assessments, you have specific rights and remedies. The process typically begins with a Letter of Authority (eLOA) from a Revenue Officer, which must be served within 30 days.

If discrepancies are found, you'll receive:

  1. Notice of Discrepancy (30 days to provide documents)
  2. Preliminary Assessment Notice (PAN) (15 days to reply)

  • 3% percentage tax fornonVATregisteredfor non-VAT registered

VAT applies to:

  • Sale of goods or properties
  • Sale of services
  • Lease of properties
  • Importation of goods

  • Method changed to accrual basis (previously cash basis for services)
